Free deliveries will be accepted to addresses within the United Kingdom, but excluding the Isle of Man, the Isle of Wight, the Scottish Islands, the Channel Islands, parts of Scotland and Northern Ireland. We can arrange deliveries outside this geographical area, but there will be an extra charge. Please contact HSL for a cost before placing your order.
Delivery will be made to the address provided at point of ordering; please ensure this is accurate. If there are specific delivery instructions, please ensure these are entered on the payment page before payment is processed. Someone will need to be present to accept the delivery, and access restrictions must be made clear. We cannot accept any liability for incorrect or invalid delivery instructions, damage, or loss of products consequently.
If no date was specified with the order, we will deliver your products as soon as reasonably possible (usually within 3-7 working days) and in any event within 30 days after the day on which we confirmed your order. The only exception to this is for products which clearly state they are pre-order / by special order or you have been advised are out of stock.
Occasionally delays to our standard delivery timescales occur during our peak season (April to September). Where possible we will advise you about any expected delay. We will not be held liable for any costs incurred as a result of delayed deliveries and will not be obligated to pay any compensation for any services employed in readiness for the delivery. If there is a considerable delay, you may cancel the contract and receive a refund on products you have paid for but not received.
We use parcel and pallet carrier networks for our deliveries, and we will not be held responsible for any delays or costs incurred due to delays caused by the carrier. If delivery is delayed for reasons beyond our control, we will contact you as soon as possible to agree a new delivery date and try to minimise the effect of the delay. We are not liable for such delays and we will not be held responsible for any losses (including loss of revenue, profits, goodwill or business opportunity or for any injury to your reputation) incurred due to a delay in delivery arising out of any cause beyond our control. We advise that you do not arrange planting or installation on the day of delivery, as items may not be delivered until 6pm of delivery day. If you have employed someone to do the planting/installation for you then please ensure you arrange for delivery of your order in plenty of time prior to them commencing work.
All deliveries require a signature, if we are unable to obtain a proof of delivery, we will be unable to deliver your products. We will contact you to re-arrange delivery, extra costs will be incurred to rearrange a second delivery. If a second delivery cannot be arranged promptly, we may charge you for storage costs. If, despite our reasonable efforts we are unable to contact you or re-arrange delivery, we reserve the right to terminate the contract and clause 10.1 will apply.
The contract will be terminated immediately if we have refused to deliver the products or you advised us before we accepted your order that delivery within the delivery date range was essential. Alternatively, you can provide us with a new date for delivery, which must be reasonable, and you can treat the contract as terminated if we cannot accommodate the proposed re-scheduled date.
If you do choose to end the contract for late delivery your order will be cancelled for any undelivered Products and we will refund any sums you have paid to us for the cancelled products and their basic delivery.
You may reject products that have been delivered if they are faulty. If you wish, you can cancel the order for some of those products (not all of them), unless separating them would significantly reduce their value. We will refund any sums you have paid to us for the cancelled products upon their return and the basic delivery cost if all items are to be returned. If the products have been delivered to you, you may arrange your own return or allow us to collect them from you and you will be charged for the collection fee.
Our products are delivered boxed or on a pallet. The packaging will be left with you at the point of delivery and it is not the responsibility of the courier to dispose of boxes or pallets. Large orders are sent on pallets and will be left where the couriers can get them to. The drivers will not unload the plants.
Risk & Ownership
Products should be checked thoroughly at point of delivery and any faults or defects reported straight away. Once the products have been signed for and accepted you become legally responsible for the products. Any subsequent loss or damage is your own responsibility. You are responsible for care, maintenance and the welfare of all the products after delivery. You will become the owner of the products once we have received payment in full.
Payment
We will always endeavor to supply the products at the published price as set out on the order page. However, if the price of the product/’s increases between the date of the order and the date of despatch, we will inform you and seek confirmation by email that the new price is acceptable and that you wish to proceed. If you do not accept, you will be entitled to cancel the order without charge.
Our charges for packaging and delivery are included in the price shown on the website unless your order does not meet with our free delivery criteria
We will charge your payment card immediately upon receipt of your order. We accept most major credit and debit cards, as detailed on our website. If your order is subsequently not accepted, we will refund the amount charged. If we cannot gain full payment for the products when the order is placed, we will not accept the order. We accept no liability if delivery is delayed by incorrect or invalid payment details.
If the rate of VAT changes between your order date and the date we supply the product, we will adjust the rate of VAT that you pay, unless you have already paid for the product in full before the change in the rate of VAT takes effect.
Despite our best efforts, some of our Products may be incorrectly priced on the website. We will normally check prices before accepting your order so that, where the product's correct price at your order date is less than our stated price at your order date, we will charge the lower amount.
If the Product's correct price at your order date is higher than the price stated to you, we will contact you for your instructions before we accept your order. If we accept and process your Order where a pricing error is obvious and unmistakable and could reasonably have been recognised by you as a mispricing, we may end the contract, refund you any sums you have paid and require the return of any Products provided to you.
If you wish to make a change to your order, please contact us immediately. We will advise you if the change is permissible. If it is possible, we advise you about any alterations to the price, delivery times or anything else due to your requested change. Before revising the order, we will seek your approval whether you wish to go ahead with the change. If we cannot affect the change or the consequences of making the change are unacceptable to you, you may request to cancel the order and indeed the contract.
